1. INTRODUCTION
These Terms of Service (the “Terms”) are applicable for users with a COS Account ("Account"). “You” means You as a consumer when You register for and use an Account. Unless otherwise stated in any additional terms, Your Account is provided by H&M Hennes & Mauritz GBC AB, and it comprises of the brands, Cos, Arket and & Other Stories. ("H&M") Reg. No. 556070-1715, Registered office Mäster Samuelsgatan 46 A, 106 38 Stockholm, Sweden.
2. REGISTERING FOR AN ACCOUNT
2.1
An Account will allow You to sign in to cos.com and see an overview of previous purchases made when logged in to Your Account and to store payment and delivery information.
2.2
By registering for an Account, You confirm that You are at least 18 years of age, or 16 years of age and have the consent of Your parent(s), guardian or legal representative as applicable, that the information You provide is true and accurate and that You agree to these Terms. Additional terms will apply for purchases and/or any supplementary services, You access through Your Account. The Account is free of charge and no purchase is necessary to register for an Account.
2.3
In order to register an Account, You need to provide us with a valid email address and choose a valid password. We only allow one (1) registered Account per email address.
2.4
The log in details will be kept and managed by the H&M group. You can find information about how the H&M group will process Your personal data when registering and using Your Account in the Privacy Notice.
3. USING THE ACCOUNT
3.1
Your Account will be available from the time, You receive a confirmation that the Account has been successfully registered.
3.2
When using Your Account it is forbidden to engage in any illegal or otherwise harmful activity. Further, it is forbidden to circumvent, or attempt to circumvent, any restrictions on use of, or availability to, the services. It is also forbidden to assist others in engaging in such activity. By agreeing to these Terms, You agree to adhere to the rules governing the use of Your Account.
3.3
To keep Your Account safe, make sure that You keep Your Account information, including information of Your user name and password, confidential. You are responsible for all activity that is conducted by You on your Account.
3.4
Your Account will be active until it is terminated by either You or Cos, Weekday, Arket and & Other Stories. You may terminate Your Account at any time, and for any reason, through Your Account settings on cos.com or by contacting Customer Service. Please note that terminating Your Account means that You will only be able to shop at cos.com using the guest checkout. If Your Account is terminated, irrespective of by You or by COS, your access to the Account will cease immediately.
3.5
If You are proven or reasonably assumed to be in violation of these Terms, we have the right to terminate Your Account without any prior notice to You and we reserve the right to refuse or terminate any new accounts, You are found to possess or attempt to register in the future.
4. LIMITATION OF LIABILITY
4.1
Your Account is provided as is. COS do not warrant that (i) the Account will meet Your requirements or expectations, (ii) the results that may be obtained from the use of the Account will be accurate or reliable, (iii) any errors in the Account will be corrected.
4.2
The functionality of, and the services available in, Your Account may vary from time to time and may be dependent on Your country or region. COS makes no warranties, except for those expressly provided for in law, for the non-interrupted access to Your Account or the services made available through the account. Any new, changed, or removed features of the Account are subject to these Terms. COS will not be liable for any system failure or malfunction of Your Account or any consequences thereof. COS accepts no liability for any loss or damages arising from suspension, variation or termination or in any other way relating to the Account, except for any liability which cannot be excluded by law.
5. MODIFYING THE TERMS
COS may, at its sole discretion, terminate, alter, limit, suspend or modify the Terms for Your Account at any time in case of changes to applicable laws, changes in services provided by us or when introducing new services, without prior notification to You, provided that these changes do not negatively affect the use of the Account. In case of other changes, You will be given prior notification via email, in-app information or via the website cos.com or a combination of these. Please make sure to stay updated on these Terms of Service for Account. You will always find the latest version of these Terms on cos.com.
6. SEVERENCE
If anything in these Terms is found to be unenforceable for any reason, this will not affect the enforceability of any other terms.
7. APPLICABLE LAW AND JURISDICTION
7.1
These Terms are governed, interpreted and applied in accordance with the laws of Sweden. However, if You are a resident of another country or region than Sweden, these Terms can be subject to mandatory consumer protection laws and regulations in force in Your country of residence which may provide You additional rights.
7.2
If You have a complaint regarding Your Account, please contact our Customer Service.
7.3
If COS is not able to settle the complaint directly, you can submit your complaint to the EU online dispute resolution platform at http://ec.europa.eu/consumers/odr/. If a solution cannot be reached, the competent authorities to settle the matter are the courts in your country of residence.
